Lusaka High Court Judge, Mwila Chitabo has set dates for hearing Hakainde Hichilema’s presidential election petition before him.
This is in a matter Hichilema the president of the opposition UPND is seeking the High Court in his presidential election petition not heard by the Constitutional Court. Hichilema says his rights to be heard were violated.
When the matter came up Tuesday afternoon today, Judge Chitabo set 15th, 19th, 20th, and 21st December 2016 as the dates to hear the main case.
Hichilema and his Deputy Geoffrey Bwalya Mwamba want to know whether their rights to be heard, as provided for in the Constitution, were violated.
What is not clear is what the UPND Leaders hopes to achieve as Edgar Lungu and his running-mate Inonge Wina have already taken oath of office and the Constitutional Court which is more superior than the High Court dismissed the presidential election petition.
Earlier, Judge Chitabo ruled that President Lungu and Vice president Wina be removed from the case because they enjoy immunity and that they be represented in court by the Attorney General.
The Judge also said that the Chief Justice, Deputy Chief Justice, and the ECZ should also be represented by the Attorney General.
