The UPND has suffered another blow in its attempt to block the inauguration of President-elect Edgar Lungu and his running-mate Inonge Mutukwa Wina after the Supreme Court dismissed the application.
Supreme Court Judge Mutuna read out the ruling in chambers. He said decisions made by the ConCourt can not be reviewed by the Supreme Court. The Judge says the single judge of Supreme Court has no jurisdiction to grant an injunction but only the full court.
He said the application is misconceived and has been dismissed
The petitioners, Hakainde Hichilema and Godfrey Bwalya Mwamba, appealed to the Supreme Court on Saturday, 10th September after the ruling of Judge Chitabo on Friday, 9th September. They also applied before a single judge of the SCZ – Judge Mutuna for the renewal of the same injunctive interim reliefs which were before judge Chitabo.
The application was heard at 10:30 hours this morning and the ruling has just been delivered. Meanwhile, a similar application for interim reliefs before the concourt which was supposed to come up at 11:30 hours has been withdrawn by the petitioners but the main matter is still active.
